Assumption of Risk & Waiver of Liability

I, {name}, fully understand and acknowledge that participation in fitness training, martial arts, strength & conditioning, youth sports development, and all other classes, services, or events offered by Peak Performance involves inherent risks. These may include, but are not limited to: falls, collisions, overexertion, equipment use, contact with other participants, unforeseen health issues, and exposure to communicable diseases such as COVID-19.

I voluntarily assume all risks, whether known or unknown, and agree that Peak Performance, its owners, trainers, employees, contractors, volunteers, and affiliates shall not be held liable for any injury, illness, disability, loss, property damage, or death that may occur as a result of my participation, regardless of cause, including negligence.

Medical Release & Responsibility

I certify that I am physically capable of participating in training and will disclose any health conditions, prior injuries, or limitations to Peak Performance staff before participating. I understand it is my sole responsibility to consult with a physician regarding my ability to safely engage in physical activity.

In the event of an emergency, I authorize Peak Performance staff to secure medical treatment for me and/or my child. I agree that I am responsible for all medical costs that may result.

Photo, Video, & Social Media Release

I grant Peak Performance unrestricted permission to record, photograph, and capture video/audio of me (or my minor child) during participation in any program, class, or event. I authorize Peak Performance to use these materials for marketing, advertising, educational, and promotional purposes across print, social media, and digital platforms without compensation.

I release Peak Performance from any liability associated with the use, distribution, or publication of these materials.
I decline the photo/media release.

Membership, Payments, & Policies

• I understand that by purchasing a membership, product, or class, I am bound by this agreement and waiver.

• Memberships and trials that automatically convert will be billed at {converted_total_amount} unless canceled before renewal.

• I understand all sales are final, and refunds are not provided once services are rendered.

• I agree to follow gym policies regarding safety, cleanliness, respect for others, and equipment use. Failure to comply may result in suspension or termination of my membership without refund.

Code of Conduct

To ensure a safe and positive training environment, I agree to the following:

• Respect: I will treat staff, coaches, and fellow members with courtesy and respect at all times.

• Safety: I will use equipment properly, follow instructions, and notify staff of any injuries, hazards, or unsafe behavior.

• Cleanliness: I will wipe down equipment after use, return weights, and maintain good personal hygiene.

• Sportsmanship: I will encourage others, avoid aggressive or dangerous behavior, and contribute to a positive environment.

• Zero Tolerance: Harassment, discrimination, bullying, or intentional misconduct will result in immediate removal from the facility without refund.

Minor Participants (if applicable)

If the participant is under 18, I certify that I am their parent/legal guardian and have the legal authority to sign on their behalf. I consent to their participation, assume all associated risks, and agree to the terms of this waiver as if signed by me personally.

Acknowledgment & Consent

I have read and fully understand this agreement. I understand that I am giving up substantial legal rights, including the right to sue Peak Performance for negligence or damages. My participation is voluntary, and I knowingly assume all risks.
